What changed after the October 1 deadline

SB 2114, Section 4 uses the exact words “reasonable attempt to execute”. By October 1, 2026, covered county law-enforcement agencies operating county detention facilities were to attempt a written ICE agreement. It does not require a particular model. Section 4(2) provides for quarterly status notification to the Department of Public Safety until an agreement is entered. Final-text mirror.

The law took effect July 1, 2026 and schedules repeal July 1, 2028. Section 8 authorizes the Attorney General to investigate alleged violations and seek declaratory or injunctive relief. The operative language is in the final bill’s body. The long title and earlier proposals use different formulations; they should not replace Section 4. The separate DPS provision in Section 3 uses a 120-day period after the effective date. It is not the county October 1 deadline.

After October 1, the decisive records are dated attempts, ICE responses, executed agreements and DPS status notifications. A signed roster entry and an application still under review are different facts. This edition has not obtained a statewide register of those submissions.

Three county records to start with

• DeSoto County: no Mississippi sheriff agreement located in the dated roster. The tracker identifies Sheriff Thomas E. Tuggle II, the county jail and records channels, and prevents confusion with Florida’s DeSoto agreement.
• Harrison County: JEM dated June 30, 2025 and WSO dated July 2, 2025; jail-focused models and local corrections context.
• Rankin County: sheriff JEM and TFM dated May 21, 2026, plus a separate Pearl Police TFM entry dated February 10, 2026.

Sheriff, city and state entries are different

The national model guide explains JEM, WSO and TFM. A sheriff may have multiple models, and a city may sign independently. Madison County’s Flora Police entry does not establish a Madison sheriff agreement. Rankin’s Pearl Police entry is separate from its sheriff’s two entries.

The workbook includes seven model rows for five state agencies: the Attorney General, Corrections (three models), Public Safety, Wildlife Fisheries and Parks, and the State Auditor. State headquarters tagged to Hinds County do not establish Hinds sheriff participation. The Auditor’s September 30, 2025 announcement is independent evidence of its own partnership, not evidence about every county.

Recent dates and unresolved records

Hancock’s sheriff TFM date is August 1, 2026; Benton’s is September 4, 2026. The source lists recent municipal dates for Poplarville (September 16), Lumberton (September 22) and Water Valley (September 23). These are roster dates, not verified operational starts or first-publication dates.

No universal post-deadline compliance count is published here. Training totals, enforcement outcomes, net county costs and the content of quarterly DPS notices require additional records.

How the comparison was checked

This edition re-extracts Mississippi entries from the official October 2, 2026 ICE workbook retained during WorthFighting’s earlier research. It distinguishes the source date from the October 7 editorial review. Fresh direct ICE requests returned HTTP 403. The Legislature’s endpoint also failed to load; its indexed final text was cross-checked with the LegiScan reproduction.

Model dates below are the workbook’s SIGNED field. We did not newly inspect inaccessible MOA signatures. A later agreement, application, rejection, training event or quarterly report may not be represented in this snapshot. No county is classified as compliant or noncompliant from roster absence alone.

The county denominator is the Secretary of State’s 82-name directory, deduplicating amended election-return links; that directory is used for geography only. We preserve raw county fields and source row numbers. “Pearl County,” “Prentiss Couty” and “Yolobusha County” are normalized with visible notes. The Meadville Police row names Sumner County, which is not in Mississippi’s county directory; it is retained in the raw total but excluded from county attribution.

The source spells one agency “Luka Police Department”; we retain and flag that spelling. Leake sheriff’s roster date is February 23, 2026, while its linked filename contains 022325; the document signature date is unresolved. Those discrepancies are not silently repaired. Of the 67 source rows, 31 are sheriff rows, 7 are state-agency rows, 28 are other local rows mapped to counties, and 1 has unresolved county attribution.

Did October 1 require every county to have a signed agreement?

Section 4 requires covered county detention-facility operators to make a reasonable attempt to execute an agreement. It does not mandate a particular model. It also provides for quarterly status notification to DPS until an agreement is entered. Roster absence alone does not settle compliance.
