TALLAHASSEE, Fla. — Florida homeowners squeezed by years of skyrocketing premiums are beginning to see early signs of stability as legislative reforms take hold across the state’s embattled property insurance sector.
According to updates provided by the Florida Office of Insurance Regulation (OIR) and state regulators in Leon County, the aggressive legal reforms signed by Governor Ron DeSantis and enacted by the Florida Legislature are finally stemming runaway litigation costs. Florida Insurance Commissioner Michael Yaworsky emphasized before legislative panels that regulatory metrics show private carriers returning to health and re-entering the market.
"We are seeing improvement," Yaworsky said, reflecting on how well carriers weathered the past season. "Stability has emerged throughout the marketplace."
Halting the Litigation Spiral
For years, Florida served as an outlier in the nation’s property insurance landscape. While the state accounted for roughly 9 percent of all homeowners insurance claims filed across the country, it regularly generated nearly 80 percent of all property insurance-related lawsuits. A web of aggressive third-party roofing schemes and assignment-of-benefits litigation forced numerous domestic carriers into insolvency, drove national companies to cancel policies, and pushed hundreds of thousands of families toward the state-backed insurer of last resort, Citizens Property Insurance Corporation.
Lawmakers met the crisis with decisive action during back-to-back legislative sessions, eliminating one-way attorney fee shifting and tightening the requirements surrounding claim dispute notifications. Data from OIR reveals that the 30-day average rate request for residential homeowners insurance recently dropped to just 1.6 percent—a dramatic shift from the 7.03 percent request rate seen just a year prior. Furthermore, 15 private carriers have submitted 22 rate filings requesting rate reductions impacting approximately 1.5 million policies, while 29 carriers proposed flat zero-percent increases for another 1.9 million households.
These market shifts demonstrate the resilience of free-market solutions when excessive regulatory and legal distortions are removed. Readers tracking how pro-growth policies combat state-level inflation can follow our ongoing reporting in our /category/economy coverage.
Depopulating Citizens to Protect Taxpayers
A critical piece of the stabilization strategy involves transitioning policies out of Citizens Property Insurance Corporation. Citizens was designed to serve solely as a safety net of last resort, but its policy count surged past 1.2 million homes as private insurers retrenched. When Citizens carries an unsustainable balance sheet, Florida taxpayers statewide remain on the hook for potential catastrophic assessments.
To correct the distortion, the Legislature authorized annual rate glide paths toward actuarially sound rates while introducing an aggressive depopulation program. Citizens requested a 14 percent average rate adjustment—the maximum permitted by statute—to ensure state-backed coverage does not undercut fair market private alternatives.
"Citizens rate request is an essential component of the ongoing stabilization of the Florida home insurance market," noted Mark Friedlander, director of corporate communications at the Insurance Information Institute. "Citizens needs to be allowed to charge actuarially sound rates versus offering coverage at below-market discount rates. It needs to stop competing with private insurers and be a true insurer of last resort as intended."
State regulators have already approved 18 private companies to absorb over 1 million policies from Citizens under the program, returning risk where it belongs: inside the competitive private marketplace rather than on the shoulders of hardworking taxpayers. Local initiatives like the state's My Safe Florida Home grant program have additionally delivered hundreds of millions in matching funds to help residents reinforce roofs, windows, and doors against hurricane-force winds.

Why This Matters
Homeownership represents the foundational engine of American prosperity and family independence. When property insurance markets collapse under frivolous trial litigation and runaway costs, middle-class families bear the brunt through unaffordable monthly payments and denied coverage.
Florida's aggressive, pro-growth response provides a nationwide blueprint for reigning in predatory legal abuse while incentivizing robust private enterprise. Restoring private capital and market discipline ensures homeowners can protect their greatest financial investment without placing public coffers at perpetual risk.
