How to Opt Out of Covered School Surveys

Use the right consent or opt-out process and keep a record that the school received your choice.

Steps to follow

  1. Obtain the exact notice and survey first. Not every questionnaire is covered in the same way.
  2. Determine whether prior written consent is required. Do not substitute an opt-out for consent where consent is required.
  3. For a covered opt-out activity, follow the school's written procedure before its stated deadline. Identify the student and specific activity through a secure channel.
  4. Request written confirmation and ask how staff will prevent accidental participation or provide an appropriate alternative.
  5. Save notices, responses and any evidence of participation. If the choice was not honored, raise the specific issue with the school and review SPPO complaint instructions.

Deadlines, limits and exceptions

Some PPRA rights transfer at age 18 or emancipation. FERPA uses a different transfer rule. PPRA does not create a universal right to opt out of all curriculum, tests or school activity. State law may add protections; Kansas's covered-survey law uses affirmative written consent.

Request wording to adapt

Use only information necessary for the school to identify and process the request. This sample is a starting point, not a legal filing.

I request that my child not participate in [identified activity] under the applicable opt-out procedure. Please confirm receipt and how this choice will be recorded and communicated to administering staff.
